Welcome to Prompted! The terms “we”, “us”, and “our” refer to Prompted. Prompted operates this store and website, including all related information, content, features, tools, products and services in order to provide you with a curated shopping experience (the “Services”). Prompted is powered by Shopify (our e-commerce platform provider) and uses Printful Inc. as a production and fulfillment partner.
These Terms of Service (“Terms”) govern your access to and use of the Services. By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
1. ACCESS AND ACCOUNT
You represent that you are at least the age of majority in your jurisdiction. You agree to provide accurate, current and complete information (including email, billing and shipping details) and to keep your account credentials secure. You are responsible for all activity under your account. You may not transfer or sell your account.
2. OUR PRODUCTS (PRINT-ON-DEMAND)
Most products are made to order (print-on-demand). Images and colors shown on the site may vary due to device settings and displays. Product descriptions, availability and prices may change at any time. We may limit quantities or discontinue products at our discretion.
3. ORDERS
Placing an order is an offer to buy. We may accept or decline any order. An order is accepted once payment is processed and we send an order confirmation. Orders may enter production shortly after confirmation and may not be cancellable once production has started (see Refund Policy). Your purchases are for personal/household use and not for resale.
4. PRICES, TAXES AND BILLING
Prices, promotions and discounts may change without notice. The price charged is the price at checkout/confirmation. Unless stated otherwise, prices exclude shipping and (where applicable) customs/import charges. VAT is applied as required by law based on your destination. You agree to provide valid payment information and authorize charges for orders, shipping, taxes and applicable fees.
5. SHIPPING, DELIVERY AND RISK
Fulfillment: We partner with Printful Inc. for production, packing and shipping.
Timelines: Production time is typically 2–5 business days. Estimated delivery windows vary by destination and carrier and are not guaranteed.
Tracking: We provide tracking where available.
Risk & Title (EU consumers): For consumer orders within the EU/UK, risk and title pass upon delivery to you (or a person you designate), not when handed to the carrier, unless you chose your own carrier not offered by us.
Delays: We are not liable for delays due to carriers, customs or events beyond our control, but we will assist you in resolving delivery issues.
6. RETURNS, REPLACEMENTS AND REFUNDS
Because items are made to order, we do not accept returns or exchanges for reasons such as wrong size, color preference or change of mind.
If an item arrives misprinted, damaged, defective or incorrect, contact contact@prompted.top within 14 days of delivery with your order number, photos and a description. Once approved, we will arrange a replacement or refund at no extra cost. Do not return items without authorization or to the address on the package. See our Refund Policy for full details.
7. INTELLECTUAL PROPERTY
All content on the Services (including text, graphics, logos, product images, designs and layout) is owned by Prompted or our licensors and is protected by applicable IP laws. You may use the Services for personal, non-commercial purposes only. No license is granted except as expressly stated. “Prompted” names and logos are our trademarks. Third-party names and marks belong to their respective owners.
8. OPTIONAL TOOLS AND BETA FEATURES
We may provide access to third-party tools or new/beta features “as is” and “as available,” without warranties. Your use is at your own risk and subject to the third party’s terms.
9. THIRD-PARTY LINKS
The Services may link to third-party websites or resources. We are not responsible for their content, policies or practices. Review their terms before engaging in transactions with them.
10. RELATIONSHIP WITH SHOPIFY AND PRINTFUL
Our store is hosted by Shopify, which provides the e-commerce platform. Purchases are made with Prompted, not with Shopify. Printful Inc. acts as our processor/fulfillment partner, handling production and shipping on our behalf. Shopify and Printful may process personal data as described in our Privacy Policy.
11. PRIVACY
Personal information is handled per our Privacy Policy (and Shopify’s privacy terms where applicable). By using the Services, you acknowledge these privacy notices.
12. FEEDBACK
If you submit reviews, ideas or suggestions (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use and display the Feedback for any lawful purpose. You represent that you own or have rights to the Feedback and that it complies with law and these Terms. We may moderate or remove Feedback at our discretion.
13. ERRORS AND OMISSIONS
Information on the Services may contain errors or omissions (e.g., product descriptions, pricing, availability, shipping charges). We may correct, change or update information or cancel orders where permitted, including after submission, if information is inaccurate.
14. PROHIBITED USES
You may not use the Services for unlawful, harmful, infringing, deceptive, abusive, harassing or malicious activities; to violate others’ rights; to distribute malware; to scrape or spam; to circumvent security; or to otherwise interfere with the Services. We may suspend or terminate access for violations.
15. TERMINATION
We may suspend or terminate the Services or your access at any time. Sections intended to survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Governing Law) will continue after termination.
16. DISCLAIMER OF WARRANTIES
Except as required by law, the Services and all products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation.
17. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Prompted and our affiliates, officers, employees, agents, contractors, service providers and licensors will not be liable for indirect, incidental, special, consequential or punitive damages (including lost profits, lost data, replacement costs), arising from or related to your use of the Services or products. For EU consumers, nothing in these Terms excludes or limits liability where it would be unlawful to do so (e.g., for death or personal injury caused by negligence, or for lack of conformity under mandatory consumer law).
18. INDEMNIFICATION
You agree to indemnify and hold harmless Prompted and our affiliates, officers, employees and agents from claims and expenses (including reasonable legal fees) arising out of your breach of these Terms or misuse of the Services.
19. SEVERABILITY
If any provision is held unlawful or unenforceable, the remainder shall remain in full force, and the affected provision will be enforced to the maximum extent permitted.
20. WAIVER; ENTIRE AGREEMENT
No waiver of any term is a continuing waiver. These Terms, together with posted policies (including the Privacy Policy and Refund Policy), constitute the entire agreement between you and us regarding the Services and supersede prior understandings.
21. ASSIGNMENT
You may not assign or transfer your rights or obligations without our prior written consent. We may assign or transfer our rights and obligations without notice.
22. GOVERNING LAW AND JURISDICTION
These Terms and any disputes arising out of or in connection with them are governed by the laws of Poland and applicable EU consumer protection laws. Courts of Poland shall have jurisdiction, without prejudice to mandatory consumer protections granting you the right to bring claims in your country of residence within the EU/UK.
23. CHANGES TO THESE TERMS
We may update these Terms from time to time. The “Last updated” date will be revised accordingly. Material changes will be notified as required by law. Continued use of the Services after changes constitutes acceptance.
